Terms of Service

Evkie provides an AI writing assistant that works in your browser and with the apps you connect. It can draft and rewrite text, suggest replies, complete sentences, fill template values, and propose times using a connected calendar. Features depend on your plan and the services you connect.

The Service is in early access and under active development, so features may change, break, or be removed. We will make reasonable efforts to give notice of changes that materially affect a paid plan.

• You must be at least 16 years old to use the Service.
• Provide accurate account information and keep it up to date.
• Keep your password and devices secure. You are responsible for activity under your account, except to the extent caused by our failure to use reasonable security.
• One person or organization per account. Do not share your account or resell access.
• We may ask for additional verification before enabling certain features.

You can close your account at any time by emailing furkan@evkie.com from the address on the account.

You agree not to:

• violate the law, infringe intellectual-property or privacy rights, send spam, harass others, or distribute malware;
• access accounts or systems you do not own or have permission to use;
• reverse engineer, scrape, overload, or attempt to bypass the security, authentication, or quota systems of the Service;
• resell, sublicense, or provide the Service to third parties without our written permission;
• use output from the Service to build a competing dataset, model, or product, or to train a generalized AI model;
• submit content you are not legally permitted to process, or sensitive data that needs a higher standard of protection than the Service provides.

We may suspend or terminate access if we reasonably believe you have violated these rules or created risk for Evkie, our users, or third parties.

You keep ownership of the text, emails, drafts, templates, and other material you submit to the Service (“User Content”). You give us a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit your User Content solely to provide, secure, and support the Service, including the writing profile we build for your account. We do not use your User Content to train generalized AI models.

You represent that you have the rights needed for us to process your User Content as described in these Terms and the Privacy Policy. You are responsible for the messages you send and for reviewing anything the Service generates before you send or publish it.

• Output is generated by automated systems and may be inaccurate, incomplete, biased, or inappropriate. It is not legal, financial, medical, or other professional advice.
• Review, edit, and approve anything the Service generates before you rely on it or send it.
• We do not guarantee that generated text will match your voice, that a proposed time will be free, or that a draft will be error-free.

The Service is offered on free and paid plans. Features, prices, billing periods, and usage limits are shown before you subscribe. Paid plans renew automatically for the same period until you cancel. Taxes may apply.

You can cancel at any time from your billing settings or by emailing us. Your plan stays active until the end of the period you already paid for, then moves to the free plan.

If a paid plan is not right for you, email us and we will refund your most recent payment, less the value of the usage you have already received. You do not need to give a reason. Refunds go back to your original payment method, and your account returns to the free plan. Nothing in this section limits refund or cancellation rights you have under local consumer law.

We may change prices or plan features with at least 30 days' notice. Changes apply from your next renewal, and you can cancel before then. Usage limits may change to keep the Service available to everyone.

Some features work with third-party services, such as Google. You can connect them at any time, and you authorize us to access and use them only to provide the features you request. You must own or be authorized to use any account you connect. Your use of those services is also governed by your agreement with the provider, and we are not responsible for their services, availability, or changes.

You can disconnect a service in Settings or from the provider at any time. Features that depend on it will stop working, and we delete the data we synced as described in the Privacy Policy. Our use of Google user data follows the Google API Services User Data Policy, including its Limited Use requirements.

The Service also relies on third-party infrastructure and AI providers. They process data on our behalf as described in the Privacy Policy.

The Service, including its software, design, text, graphics, logos, and trademarks (but excluding your User Content), is owned by Evkie or its licensors and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, or create derivative works of the Service except as permitted by law or with our written consent. If you send us feedback, you grant us a perpetual, royalty-free license to use it without obligation to you.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, if we reasonably believe your use creates risk or harm, or if we discontinue the Service. Where practical, we will give notice and an opportunity to export your data. On termination, your license ends and we delete your data as described in the Privacy Policy, except for records we must keep by law or for security purposes.

Sections that by their nature should survive termination, including ownership, disclaimers, limitation of liability, indemnity, and governing law, will survive.

We work hard to keep the Service reliable, but we cannot promise it will always be available or error-free. We use capital letters below so this part is easy to notice.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that generated output will be accurate or suitable for your use.

To the maximum extent permitted by law, Evkie will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Service or these Terms, even if we have been advised of the possibility of such damages.

Our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) one hundred US dollars (USD 100).

Some jurisdictions do not allow the exclusion of certain warranties or damages, so some of the above may not apply to you. Nothing in these Terms limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any liability that cannot be limited by law.

To the extent permitted by law, you will defend and indemnify Evkie and its officers, employees, and agents against claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your breach of these Terms, except to the extent caused by our own negligence or willful misconduct. We will notify you of a claim and may participate in its defense.

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The courts of Istanbul have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, except that mandatory consumer-protection rules in your country of residence continue to apply.

We may update these Terms from time to time. We will post the new version here and update the date above. If a change is material, we will notify you by email or in the Service before it takes effect. Continued use of the Service after the effective date means you accept the updated Terms.

• These Terms and the Privacy Policy are the entire agreement between you and Evkie about the Service.
• If any provision is found unenforceable, the remaining provisions stay in effect.
• Our failure to enforce a provision is not a waiver of our right to do so later.
• You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.
• We are not liable for delays or failures caused by events beyond our reasonable control.
• Headings are for convenience only and do not affect interpretation.
